[MEXT] Partial Revision of the Ordinance for Enforcement of the School Education Act

On 23 August 2021, the Ministerial Ordinance for Partial Revision of the Ordinance for Enforcement of the School Education Act (Ordinance of the Ministry of Education, Culture, Sports, Science and Technology No. 37 of 2021) was promulgated. It came into effect on the same day.

Challenges faced by schools and teachers are becoming more diverse and complex. The urgent issues for schools include promoting work-style reform in schools, the steady implementation of the GIGA School Initiative, and the support for students with special needs, including medical care needs. Therefore, the revision stipulates the new job titles and descriptions as support staff who play an essential role in cooperation with school teachers: Medical care nursing staff, Information and communication technology support staff, Special need education support staff, and Teacher work support staff.

The outline of the revision is as follows.

(1) Medical care nursing staff

Those who are engaged in the medical care of children who need regular medical intervention in elementary schools, such as respiratory management with a ventilator, sputum suctioning, and other medical treatments for daily life and social life. [Article 65-2 of the Ordinance for Enforcement of the School Education Act (Ordinance of the Ministry of Education No. 11 of 1947) (hereinafter referred to as the "Ordinance for Enforcement")].

(2) Information and communications technology support staff

Those who are engaged in supporting the use of information and communication technology in educational activities and other school management(Article 65-5 of the Ordinance for Enforcement)

(3) Special need education support staff

Those who are engaged in providing necessary support for the learning or living of children with special educational needs. (Article 65-6 of the Ordinance for Enforcement)

(4) Teacher work support staff

Those who are engaged in providing the necessary support for the smooth implementation of teachers' work.(Article 65-7 of the Ordinance for Enforcement)

In addition, (1) to (4) above shall be placed in the regulations concerning personnel in elementary schools and shall apply to kindergartens, lower secondary schools, compulsory education schools, upper secondary schools, secondary education schools, and special need education schools (Article 39, Article 79, Article 79-8, paragraph 1, Article 104, paragraph 1, Article 113, paragraph 1 and Article 135, paragraph 1 of the Ordinance for Enforcement)

(5) Application of the provisions concerning school counselors and school social workers to kindergartens

The provisions concerning school counsellors and school social workers shall be applied to kindergartens. (Article 39, Article 65-3 and Article 65-4 of the Ordinance for Enforcement)

(6) Date of enforcement

The enforcement date of the Ministerial Ordinance was set as the day of promulgation (August 23, 2021).
