[MHLW] The Situation of Disability Abuse by Employers in FY2021 Unveiled

On September 7, 2022, the Ministry of Health, Labour and Welfare (MHLW) revealed the results of the "Situation of Abuse against Persons with Disabilities by Employers" in the fiscal year 2021.

This publication summarizes abuse against persons with disabilities by employers as ascertained by the Prefectural Labour Offices according to Article 28 of the Act on the Prevention of Disabled Abuse, which stipulates that "The Minister of Health, Labor and Welfare shall publicize the abuse of persons with disabilities by employers. Furthermore, measures taken in the event of abuse of persons with disabilities by employers and other matters prescribed in the Ordinance of the Ministry of Health, Labour and Welfare shall also be made public every fiscal year."

The compilation period covers reports and notifications received between April 1, 2021, and March 31, 2022. It covers cases reported to the Labour Bureau by prefectures in accordance with Article 24 of the Act on the Prevention of Disabled Abuse, cases where the Labour Bureau, Labour Standards Inspection Offices, or Public Employment Security Offices directly receive information or consultation from abused persons, family members or colleagues to the effect that there is a possibility of abuse of persons with disabilities by the employer, and other cases. In addition, the cases include those where on-site inspections by the Labour Standards Inspection Office or visits to workplaces by the Public Employment Security Office have identified cases that may fall under the category of abuse of persons with disabilities by employers.

The notable points of the results are as follows:

1.The number of reported or notified establishments was 1,230, which decreased by 3.7% compared to the previous fiscal year.

The number of persons with disabilities subject to reporting and notification increased by 1.6% to 1,431 compared to the previous year.

2.The number of establishments where abuse was found was 392, a 2.2% decrease from the previous year.

The number of persons with disabilities found to have been abused was 502, an increase of 0.8% from the previous year.

3.In terms of the type of abuse found, economic abuse was the most common at 420 (77.6%), followed by psychological abuse at 61 (11.3%) and physical abuse at 32 (5.9%).
