[MHLW] A Decision Has Been Made on the Date of Application for Private Business Operators to Provide Reasonable Accommodation under the Act to

Eliminate Discrimination against Persons with Disabilities

With the promulgation of the "Cabinet Order to Provide for the Date of Enforcement of the Act on the Partial Amendment of the Act to Eliminate Discrimination against Persons with Disabilities (Cabinet Order No. 60) on March 17, 2023, reasonable accommodation under the Act to Eliminate Discrimination against Persons with Disabilities (Act No. 65 of 2013) shall apply to private business operators from April 1, 2024.

The Act on the Partial Amendment of the Act to Eliminate Discrimination against Persons with Disabilities (Act No. 56 of 2021), promulgated on June 4, 2021, includes a provision obligating businesses to implement reasonable accommodation as prescribed in Article 8, Paragraph 2 of the Act , while its Supplementary Provisions set out that "This Act shall come into force from the date specified by a Cabinet Order within a period not exceeding three years from the date of promulgation." In line with it, a Cabinet Order that specifies the enforcement date was issued after the Cabinet made that decision on March 14, 2023.

The Cabinet Order as shown below was published in the Official Gazette (Extra No. 53) on March 17, 2023.

The Cabinet Order to Provide for the Date of Enforcement of the Act on the Partial Amendment of the Act to Eliminate Discrimination against Persons with Disabilities (Cabinet Order No. 60)

The Cabinet hereby enacts this Cabinet Order pursuant to the provisions of the Supplementary Provisions of the Act on the Partial Amendment of the said Act (Act No. 56 of 2021).

The effective date of this Act shall be on April 1, 2024.
