[MHLW] Revision of the Basic Policy on Measures for Employment of Persons with Disabilities and Guidelines for the Preparation of a Plan to Promote the Activities of Persons with Disabilities

On March 13, 2023, the Ministry of Health, Labour and Welfare (MHLW) consulted the 127th Labour Policy Council (Committee on the Employment of Persons with Disabilities) for the draft revision of the Basic Policy on Measures for the Employment of Persons with Disabilities (MHLW Issue No. 0313 No. 1, dated March 13, 2023) and the Guidelines for the Preparation of a Plan to Promote the Activities of Persons with Disabilities (MHLW Issue No. 0313 No. 2, dated March 13, 2023). The Council approved the draft as appropriate.

The Minister of MHLW prepared and published the Basic Policy on Measures for the Employment of Persons with Disabilities as the primary policy to ramp up the employment of persons with disabilities and their job security, according to the Act to Facilitate the Employment of Persons with Disabilities (Disability Employment Facilitation Act).

The previous basic policy, which was in effect from fiscal year 2008 to fiscal year 2022, was thus updated. The update reflects the following components of the Disability Employment Facilitation Act, as amended in December 2022:

1. Vocational guidance at public employment security offices for those who wish to find work in the general employment market and for those who have received support under the Vocational Choice Support scheme, which is newly created as per the Act on Comprehensive Support for Persons with Disabilities, while referring to its assessment results.
2. Allowance for special working hours for persons with severe physical disabilities, persons with severe intellectual disabilities, and persons with psychosocial disabilities whose weekly working hours are between 10 to 20 hours for it to be included in the calculation of the actual employment rate so as to expand their employment opportunities.
3. Review of the modes of payment of the Adjusted Allowance for the Employment of Persons with Disabilities and to strengthen subsidy measures for companies that help them get settled in the workplace.

Furthermore, the Minister of MHLW prepares the Guidelines for the Preparation of a Plan to Promote Activities of Persons with Disabilities as per the provisions of Article 7-2, paragraph 1 of the Disability Employment Facilitation Act; therefore, the national and local governments must prepare the Plan in accordance with these guidelines.

These guidelines have also been revised to reflect the amendments to the Disability Employment Facilitation Act.
